By downloading, accessing, or using CloneCascade (the "Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Software. These Terms apply to all users, including administrators and end-users.
CloneCascade is a desktop-based media forensics and format conversion tool. It allows users to analyze, compare, and convert media files (images, videos, GIFs) locally on their own devices. The Software operates independently of CloneCascade's servers and does not upload user media files to any cloud service.
You are solely responsible for your use of the Software and any content you process with it. This includes, but is not limited to, ensuring that you have all necessary rights, licenses, and permissions to copy, modify, and distribute the media files you process. You agree to use the Software in compliance with all applicable local, state, national, and international laws.
CloneCascade is provided as a tool for legitimate media editing, format conversion, and personal use. You agree not to use the Software for any unlawful purpose. This includes, but is not limited to, using the Software to:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLONECASCADE AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SOFTWARE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY RELATED TO THE SOFTWARE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. THE SOFTWARE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. YOUR USE OF THE SOFTWARE IS AT YOUR SOLE RISK.
You agree to defend, indemnify, and hold harmless CloneCascade and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Software, or b) a breach of these Terms.
CloneCascade PRO is offered as a monthly subscription. Payments are processed by Stripe. By subscribing, you authorize recurring monthly charges until you cancel. You may cancel at any time from your account dashboard. Cancellation takes effect at the end of the current billing period.
We may terminate or suspend your access to our Software immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Software will immediately cease.
These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any material changes. By continuing to access or use our Software after any revisions become effective, you agree to be bound by the revised terms.
